1. Acceptance of Terms

By accessing, scheduling, purchasing, or receiving services from NuBian Aesthetics & Wellness Inc. (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service. These Terms apply to all website visitors, clients, prospective clients, and users of our services, communications, and booking systems.

2. Services

NuBian Aesthetics & Wellness Inc. provides aesthetic, regenerative, wellness, and educational services which may include, but are not limited to:

• Neuromodulator treatments
• Dermal filler treatments
• PRP/PRF regenerative treatments
• PDO thread procedures
• Microneedling and skin rejuvenation services
• Wellness injections and related wellness services
• Consultations and treatment planning

All services are subject to provider evaluation, medical appropriateness, availability, and informed consent requirements.

3. Medical Disclaimer

All aesthetic and wellness services are elective. Individual results vary and cannot be guaranteed. Information provided through our website, social media, text messaging, email communications, or consultations is educational in nature and does not establish a provider-patient relationship until appropriate consent and medical evaluation have been completed.

Clients are responsible for providing accurate and complete medical history information and notifying the provider of any changes in health status, medications, allergies, pregnancy status, or medical conditions.

4. Eligibility

Clients must be at least 18 years of age to receive treatment unless otherwise permitted by applicable law and accompanied by appropriate parental or guardian consent.

5. Scheduling & Deposits

Appointments may require a non-refundable deposit to reserve treatment time. Deposits may be applied toward services rendered unless otherwise stated.

Failure to attend scheduled appointments, cancellations within the required notice period, or repeated rescheduling may result in forfeiture of deposits and/or restrictions on future booking privileges.

6. Cancellation & Late Policy

Clients are expected to provide a minimum of 48 hours’ notice for appointment cancellations or rescheduling requests. Late arrivals may result in shortened appointments, rescheduling, or cancellation at provider discretion.

7. Payment Terms

Payment is due at the time services are rendered unless prior financing arrangements have been approved. Accepted payment methods may include cash, credit/debit cards, financing platforms, memberships, or approved payment plans.

Clients remain financially responsible for all services provided.

8. Memberships & Promotional Offers

Memberships, promotions, event pricing, treatment packages, gift cards, and promotional offers are subject to separate terms and conditions and may not be combined unless expressly stated.

Membership credits, promotional pricing, and special offers have no cash value and are non-transferable unless otherwise specified.

9. Communication Consent

By providing contact information, clients consent to receive communications from NuBian Aesthetics & Wellness Inc. including appointment reminders, treatment follow-ups, practice updates, educational communications, and promotional messages where permitted by law.

Message frequency may vary. Message and data rates may apply. Clients may opt out of marketing text messages at any time by replying STOP.

10. Privacy & HIPAA

Client privacy is important to us. Protected health information is handled in accordance with applicable privacy laws and HIPAA requirements where applicable. Additional information regarding privacy practices may be provided separately through our Notice of Privacy Practices.

11. Photography & Media Consent

Clinical photography may be recommended for documentation, treatment planning, and progress tracking. Separate written consent will be obtained before any identifiable photographs or videos are used for marketing, education, or promotional purposes.

12. Treatment Outcomes & Risks

All medical aesthetic procedures carry potential risks, side effects, downtime, and complications. Clients acknowledge that they have been informed of potential risks and alternatives prior to treatment.

Clients agree to follow all pre- and post-treatment instructions to help optimize outcomes and reduce risk.

13. Intellectual Property

All branding, logos, written content, graphics, educational materials, website content, and marketing materials associated with NuBian Aesthetics & Wellness Inc. remain the property of the Company and may not be reproduced without written permission.

14. Limitation of Liability

To the fullest extent permitted by law, NuBian Aesthetics & Wellness Inc. shall not be liable for indirect, incidental, special, or consequential damages arising from the use of services, website content, communications, or products.

15. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Updated terms become effective upon posting or distribution.

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Hawaii.
